Federal Judge Orders Freedom of Kilmar Abrego Garcia from ICE Custody
A court has ordered the prompt release of Kilmar Abrego Garcia from detention by ICE, concluding his continued detainment is without legal authority.
"Since Abrego Garcia's release after wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her ruling.
The situation stems from a erroneous deportation to El Salvador earlier this year, which US authorities later admitted was an error. After his return to the United States to answer human smuggling charges, he was detained in federal detention.
In her order, the court pointed out that the government does not have a valid removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."
Context of the Case
The court challenge center on conflicting claims. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he categorically disputes this allegation.
He has also entered a not guilty plea to the smuggling counts, which are part of a ongoing trial in Tennessee.
